Real estate attorneys are more important in a home building process than you would think. As a matter of fact, you can not start a home building process before the real estate attorney assists you in acquiring a property.

James has 16 years experience as an attorney in real estate and development, and his background recommends him as a trusted professional. James remembers that his collaboration with Gialluisi Custom Homes began two years ago, when he and Peter met because, as he says, “I also live in Westfield, and I know the area very well. This is a great advantage in real estate, because every region is different, so you need someone experienced to help you with the legal paperwork.”

When asked about his responsibilities in working with Gialluisi, James highlights he deals with all the legal work involved in buying and selling properties.

What sets James apart from other real estate attorneys?

In the real estate business, success is in the details. One important thing that sets James apart from other real estate attorneys is the fact that he works with a very well-structured team. “When you have all of those people who are specialists in a particular legal area,” James points out, “the transactions are much smoother, because everyone knows what they need to do, and they do it quickly and professionally.”

Together with his team, James does his own settlements, because he feels that “this is the most important part of a transaction.” This is an aspect that is ignored by most real estate attorneys, but not by James, who considers this as a responsibility that should be taken very seriously.

How does James collaborate with Gialluisi Custom Homes?

1. Acquiring properties

“They find properties that they want to develop,” says James, “and I assist them with the legal process of acquiring those properties. I will then assist Gialluisi with the sale of those same properties once they are rebuilt or renovated.” He continues saying that, “There are several development issues that I offer my assistance on.”

2. Getting the legal approval for home building and renovations projects

If you have bought a house from Gialluisi Custom Homes, then you probably have papers James prepared, reviewed, or signed. James reviews legal documents such as contracts, and he assists our team if we need to go before a particular board in order to get approval for a particular project.

”I will assist Gialluisi in all matters that regard planning boards, board of adjustments, various applications, land use, development and so on,” says James.

3. Assisting clients with land use and zoning applications

One important thing to know about James is that he does not work directly with our clients.

However, there are a few exceptions when clients will utilize his services regarding the land use and the zoning application. We are always happy to put our clients in direct contact with James whenever they need his services.

“Gialluisi may have a client that wants to build something,” explains James. “In this case, I will be the person who assists that client to get the approvals they need. Once that task is completed, then Gialluisi can start the construction process.”

If clients want to build a larger home than they are normally allowed to build on a certain lot, James will assist them to get approval from the town council to build a slightly larger home while remaining within the boundaries imposed by the law.

The most rewarding thing about his profession…

Closing a real estate deal can be more difficult than it sounds: it is possible that, when you are trying to buy a new home, you may face various challenges. These can range from difficulties with getting your loan approved, regulations, approvals.

To James, these are the things he loves about his job.

“I think to be able to navigate that, to see a deal closed and to see a ribbon cutting on a new building, that’s probably the most rewarding thing, at least in working with Gialluisi,” he says.

He adds that he loves working with clients and seeing people move into a new home. In his opinion, starting a new life with your family in a new place should be seen as a bright beginning, free of the hustle and bustle of legal paperwork. The nicest thing about being a real estate attorney, he adds, lies in the fact that he is able to give clients the chance to move into a new home knowing that all the legal aspects are being taken good care of.
If he were to give you one piece of advice, James would…

He would insist on telling you that, “in terms of the contract, you have to have an experienced attorney in real estate.”

James explains that, unless you have an experienced real estate attorney who knows exactly what they are doing, a lot of things could fall through the cracks. “I think a homeowner or a homebuyer needs to really make sure that they get an attorney that is experienced and knowledgeable,” explains James, highlighting that the attorney should be qualified “not in other types of law, but in real estate transaction and residential home ownership in a very localized community.”
